Criminal Law: Understanding Your Right

Hello, my name is Wendy. Last year, I got my first taste of Australian law when I was accused of a serious crime. I run my own business and one day, the place was raided by the police who were investigating alleged financial fraud. I was taken in for questioning and then released on bail. I was really worried but then I found a great criminal lawyer who explained what was going on and how I could defend myself. When the case finally came to court, my lawyer was ace and all charges were eventually dropped against me. I hope my blog is useful.

Can a solicitor help you gather evidence for a defamation lawsuit?

The world has become amazingly interconnected, which makes it easy to reach people from every corner of the world within seconds. However, the same interconnectedness can also be a curse because reputations that have taken years to build can be destroyed by a single click of the mouse. Defamation cases are draining in terms of time and money, and they also cause a lot of stress and shame to the victim. However, when you have the assistance of a solicitor who understands libel law, it will be very easy to get legal redress for the problem.

When the subject of libel is honest opinion

One of the most difficult libel cases to deal with is when the person involved in the defamation believes they are giving their honest opinion on a subject of interest to them. For instance, critics and commentators on something may utter defamatory statements when they believe to be giving their honest opinion. When this happens, you as the offender will be tasked to prove that you were simply expressing an opinion based on a fact or other point of privilege. Solicitors understand what qualifies as viable evidence in such cases and what may not work.

What the solicitor will do

The main aim of getting a solicitor to deal with your libel suit when you are the victim is to get an injunction prohibiting the perpetrator from making similar assertions in the future, compensation for all legal costs associated with the case and damages for any distress and injury caused by the defamation. Other things that the solicitor will negotiate for you are a public apology from the person who made the statement, a public retraction of the statement and a promise not to publish similar statements.

When you don't know who made the statement

If you are in a situation where you do not know the person who made the statement, and they were probably acting for a company or other entity, your solicitor will help you get a disclosure order for the company. They will then send a letter of claim to the defendant, detailing your case and your demands.

The process of resolving a defamation case is a little complicated and needs the guidance of a competent solicitor. You should ensure that you engage a solicitor who has a clear understanding of how libel works as this will speed up the process for you and save you from serious damage.
